Does the principle of westphalian sovereignty still exist?
The westphalian state sovereignty system was established in 1648 there were three core factors to it:
- The principle of state sovereignty,
- The principle of legally equal states
- The principle of non-intervention in the international affairs of the other state.
The westphalian sovereignty had become universally accepted system, and it is practised by all the states. This model plays major role in today's world. Every state have its own rules and regulation inside its territory and is equal to other state. Due to this system no state can intervene in the other state, but some changes have been brought to this system by making sovereignty as responsibility and state has to take care of human rights and if it will violate the human rights, then the international organisations can intervene.
This giving privilege to the state to make its decision and govern itself in the hope of building interstate peace. How powerful a state is still can not intervene into the matters of the other state. Today this principle exist and many states violate the human rights but are not still intervened by any state. Kashmir ruled under Indian government had curfew over 100 days and no state intervened and none of peace talks were held. Armed forces killed more than 100 people and many lost their vision due to the ballet guns.
The unsafe situation in middle east between Palestinians and Israelis. Israeli soldiers committed number of gross human rights violation. A UNICEF reported that 700 children aged between 12 to 17 are detained in Israel prisons and they are subject to death threats and sexuall assault by Israeli miltiary and police in occupied west bank. These violation of human rights and no state is intervening is the example that Westphalian sovereignty still exist.
Whereas critics believe that Westphalian does not exist anymore. When Bashar al Assad (government) attacked his people who were protesting against him, other states started getting involved in the matter. Today in Syrian conflict many state like US and Russian are involved and they are bombing both sides because USA is supporting rebels and Russia is supporting Bashar al Assad. World has divided on this matter and some states support him and other supports rebels.
During the last days of Gaddafi regime USA, UK and France started airstrikes on Gaddafi because he violated the human rights by killing his own people. These states made it difficult for Gaddafi to escape and later on he was captured by the people and shot. By seeing these examples it looks that Westphalian sovereignty do not exist.
On seeing the whole Westphalian sovereignty system exist for states with more hard power but not for the states with less hard power.
